Terms & Conditions

  1. If you want to take part in a SEGWAY tour, you have to be at least 8 years old / minimum weight 20KG
  2. Prior to starting the drive, it is imperative that you carefully understand the permitted areas where you are allowed to drive with the Segway and where not. We recommend that Segways be driven only on safety lanes, road sides or lanes as advised by the tour guide. 
  3. The driver must have a minimum weight of 20 kg and a maximum weight of 125 kgs.
  4. The age of the participant has to be between 8 and 65 years. All minors under age 15 are advised to be accompanied by an adult/major.
  5. It is mandatory that you attend the safety instructions lesson beforehand.
  6. Wearing a helmet and other safety gears are mandatory. Our helmets and safety gears are appropriately sanitised at all times and are provided free of charge and on returnable basis.
  7. Post the training session, should you or the tour guide recommend that you should not take part in the tour due to any reason, the tour price will be refunded, subject to conditions.
  8. Please let yourself be extensively instructed in the handling of the Segway: functionality and explanation of the InfoKey controller, mounting and dismounting, acceleration and braking, steering left/right. The warning signals of the SEGWAY (the red blinking of lights and a vibration of the platform signalise that the drive is to be ended immediately and the vehicle has to be quit in a safe manner). Ignoring these warning signals can lead to the vehicle shutting off automatically.
  9. Never dismount while driving, both feet have to be on the Segway platform at all times. There has to be weight on the pressure sensors permanently.
  10. The Segway driver is not permitted to take pictures or to film during the drive. Both hands have to be on the handlebar at all times, never drive without using your hands. Hand signals have to be given when turning (the same as on a bicycle).
  11. Drive only at walking pace during the test drive or on the course.
  12. Keep a distance of at least 3 metres to the next driver. A minimum clearance of 1 metre has to be also kept on both sides. Pay heed to bumps on the ground and any damage to the road surface. Do not drive over potholes or through puddles. Pay attention to sidewalk kerbs or similar obstacles. Please do not attempt to drive over these or you could fall. If in doubt, dismount and pull the Segway over the obstacle.
  13. Only one driver per vehicle. It is prohibited to take along any more persons or infants.
  14. The instructions of the Bird Hospitality Services Private Limited (BHS) or their employees have to be obeyed at all times. Ignoring the instructions can lead to ending the drive. In this case, no refund of the entry fee or rental fee will be refunded. The same applies in case there is cause for suspicion of intoxication due to alcohol or drugs.
  15. The vehicle may not be transferred to third parties.
  16. After ending the drive, the vehicle as well as all accessories and equipment have to be given back to the BHS in the same condition as before the tour. All damages or the absence of equipment or absence of the device itself shall be charged in their entirety to the leaser.
  17. Using the Segway, accessing the course or tour route and the stay, as well as participation in any activities, are performed solely and without restrictions at the customer’s own peril and risk.
  18. Driving the Segway, using the course or taking part in a tour is allowed only to persons who have taken notice of and have signed the present safety guidelines and the disclaimer of warranty declaration.
  19. BHS does not assume liability for damages that, in particular, emerged from the operation of Segways, unless damages have been caused by BHS or its employees through gross or wilful negligence. 
  20. Each user of the vehicles bears responsibility in terms of civil and criminal law for damages to persons, property or for financial loss caused by him or the vehicle that he has been driving.
  21. The use of the Segways is not allowed to persons who suffer from physical handicaps or who are under the influence of alcohol, drugs or medication. Pregnant women or persons who have heart problems and/or high blood pressure are expressly advised not to use the SEGWAY.
  22. The instructions of the tour leaders, trainers and operational staff have to be obeyed when using the Segways. BHS does not assume liability for damages that were caused by own or third party fault, by accident or improper handling; or for damages that were caused by disobeying instructions from the operator/renter or his employees.
  23. In case of accident or damage, the driver is fully responsible for all damages and will be charged to 100%, concerning damages of third parties.
  24. The Participant and/or their parent(s) or guardian (in case of minor being participant) understands, acknowledges, and agrees that driving a Segway vehicle can entail considerable risk of a physical injury, even resulting in loss of life. While rules, equipment and personal discipline may reduce this risk, participants of a Segway Tour assume full responsibility for any risk of injury, property damage, or loss of life during the course of a Segway Tour. Participants knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of BHS.
  25. Participant and/or their parent(s) or guardian (in case of minor being Participant) hereby waive and release BHS from all liability for any loss, damage or expense, and any and all claims including, but not limited to, bodily injury including death and property damage they may have against BHS, and all sponsors of the Segway Tour and their subsidiaries, affiliates, partners, officers, directors, employees, agents, and volunteers arising out of Participant’s use of the Segway Tour.
  26. Participant and/or their parent(s) or guardians agree(s) guardian (in case of minor being Participant)  shall abide by and will follow the instructions as provided hereunder or by the Segway Tour instructors. Failure to follow instructions may result in the termination of Participant’s use of the Segway Tour without refund. 
  27. Under no circumstances and under no legal or equitable theory, whether in contract, tort, strict liability or otherwise, shall BHS or any of its affiliates, employees, directors, agents, sponsors or operators be liable to the participant and/or its parent or guardian for any loss or damage arising out or in connection with the participant participating in any Segway tour or related activity in excess of the fees paid for availing the tour.
